"CHILLICOTHE ― Citizens can rejoice as the Floral Hills Memory Gardens conflict comes to a resolution, but Huntington Township trustees grapple with mounting financial challenges.

 The cemetery owned by Ronald Downey and Joseph Miller has been abandoned for over 10 years and has since been cared for by volunteers. The property owes almost $19,000 in back taxes, according to Ross County Treasurer Dave Jeffers.

 At the Aug. 17 status conference, Judge Michael Ater decided the cemetery was public and ownership should be transferred to Huntington Township. Ross County Prosecutor Jeffrey Marks said this decision, "takes away the biggest logistical hurdle to resolving this matter."

 Huntington Township does not officially own Floral Hills Memory Gardens. The next status conference is scheduled at 11 a.m. Sept. 25 at the Ross County Courthouse.

 Marks said the next step is to resolve any tax liens.

Huntington Township Trustee John Cottrill said Huntington Township manages 10 cemeteries. Floral Hills, which would be its 11th property, is larger than every other cemetery combined.

 Community comes together to help Huntington

 Army Veteran Dave Robertson runs the Clean Up Floral Hills Memory Gardens Facebook page and has been the main caretaker of the cemetery since it was abandoned. However, he stopped caring for the cemetery to prompt a response from the court.

 "What I promised Huntington township was if they got [the cemetery] I would put it back to the way it was two years ago when I walked away from it," Robertson said. "It's going to be a nightmare to get that back under control." "

 Robertson is planning on forming a volunteer group to clean up the cemetery one last time before Huntington officially takes over. Cottrill said Robertson plays a crucial role in getting the cemetery, "back to order."

 Huntington Township would have some funds to care for the cemetery, according to Huntington Bank Representative Timothy Long, with access to an endowment fund that generates about $800 to $900 a month in interest per month. However, the township would have to find a way to fund upfront expenses.

 Cottrill said the cemetery would cost Huntington about $300,000 for new equipment and building, bridge and driveway repairs. The entrance bridge to the cemetery requires urgent repairs, with an estimated repair cost of $120,000.

 Before the status conference, Huntington Township trustees approached the Ross County Commissioners to seek financial aid in case the township assumed responsibility for the cemetery. Commissioner Dwight Garrett expressed willingness to explore assistance during the initial transition and restoration if the property was transferred to the township.

 Cottrill said the township also plans on approaching state representatives for financial assistance.

Sharing this sad news from the Scioto Valley Guardian regarding the Floral Hills Memory Gardens in Ross County, Ohio.

Floral Hills Memory Gardens in Ross County, Ohio has been featured in this blog with links to several newspaper articles for a number of years, however, not for the reason it is being covered in this story. 

It appears from the reports provided in this account, a fire stemming from an undocumented origin raged through the grounds of Floral Hills Memory Gardens located in Huntington Township, Ross County, Ohio.

The accompanying pictures show the large area of damaged scorched earth that devastated "nearly an acre" of the cemetery property.  Sadly, close up images show flat bronze markers that were severely blackend.

Per Find A Grave, 3,721 people are interred at Floral Hills Memory Gardens.

Hoping for an update soon to learn exactly how this fire was caused and by whom.

The looming unanswered questions are how and when will all of the vast damage to the grounds and markers be repaired; keeping in mind also that Floral Hills Memory Gardens has no owner responsible for it?

When will Floral Hills Memory Gardens in Huntington Township, Ross County, Ohio finally get an owner -- or even a receiver?

On September 7, 2019 - The Facebook page of "Clean Up Floral Hills Memory Gardens" -- that was created for the active but abandoned Floral Hills Memory Gardens cemetery situated in Huntington Township, Ross County, Ohio posted their most dire statement thus far pleading for the public's help.:
"Please don’t let the lack of action by the legal system destroy their resting place.  
Call, Fax & Email to demand action for the Ohio Dept of Commerce to “apply” to the Local Court to appoint a Temporary Trustee/Receiver for Floral Hills-Chillicothe.

More details, written in 2013, that describe how this serious problem arose are found in the "About" Section on the "Clean Up Floral Hills Memory Gardens" Facebook Page. 
(Paraphrased below.):
 "A sad neglected Cemetery that is being forgotten by our leaders. The owners have abandoned it and the Township refuses to care for it. The Attorney Generals Office has filed suit against it....but it sits in the hands of the legal system unkempt.
 A cemetery that is located at 4284 US Route 23, Chillicothe, Ohio 45601. 
The owners were, Joseph Miller who filed Chapter 13 after fleeing to Nevada, and his partner, Ronald Downey, who has fled to Michigan. Neither has left any means of upkeep and care of the grounds, and are refusing to honor any of the prepaid services that have been purchased through the cemetery. 
The Attorney General filed a suit against the 2 owners in May 2012, with nothing of any significance being done to get a resolution to the problem. One of the items Mr Miller is trying to do is surrender the property in lieu of taxes owed. By ORC (Ohio Revised Code), the property would then be handed over to the Township where the cemetery property is located, which is in Huntington Township, Ross County.
 The problem is Huntington Township has refused to accept responsibility for the grounds due to the trustees claiming they are not financially able to maintain the grounds. They also state that they have sought guidance through their "Prosecutor" and have been advised that they do not have to take it. 
With all the legal issues aside, it is the attempt by this group to bring this tragic situation to the public and clean up the cemetery grounds; and find a resolution to further maintenance of the grounds."
Sadly, the entire situation has seriously worsened in six years despite the continuing efforts by all who have volunteered to help maintain the grounds and gravesites.  It isn't fair and it should not have to continue.

"Upon receipt of information that the owner or person responsible for the operation of a registered cemetery or a cemetery that was required to be registered has ceased operation of that cemetery, the division of real estate in the department of commerce may investigate for purposes of determining the cemetery's current status.
If the division finds evidence that the cemetery has ceased operation and a municipal corporation or township has not assumed day-to-day management of the cemetery, the division may apply to the court of common pleas of the county in which the cemetery is located for appointment of a temporary receiver or trustee. The order appointing the temporary receiver or trustee shall order the trustee or trustees of the endowment care trust of the cemetery to make distributions to the receiver or trustee in accordance with section 1721.21 of the Revised Code.
The receiver shall only be paid from the income of interest and dividends in the endowment care trust being held pursuant to section 1721.21 of the Revised Code. The receiver may not invade the principal or capital gains of the trust.
